1. General

The Wallace website (the “Site”) is operated by Amit Reem, licensed dealer (“osek murshe”) no. 311290373, registered at Nehemiya 6, Herzliya (“the Business”, “we”). Browsing and purchasing on the Site are subject to the terms set out below, and browsing and/or purchasing on the Site constitutes agreement to these terms.

3. Who Can Use This Site

Browsing the Site is permitted at any age. Purchasing on the Site is intended for users with legal capacity aged 18 and over; a purchase by a minor under 18 requires the approval of a parent or guardian.

4. Acceptable Use

Use of the Site is permitted for private, personal purposes only, and not for commercial purposes, unless approved by us in advance and in writing. Among other things, you may not: harvest content from the Site to build a competing database or product; use bots, scripts, or other automated tools to access the Site; attempt to bypass, disable, or breach the Site’s security measures; impersonate another person; or take any action that violates the law. We may, at our sole discretion, restrict or block access to the Site for a user who breaches these terms, without prior notice.

5. Intellectual Property

All content on the Site – including design, images, text, code, and trademarks – is the exclusive property of Wallace and/or its suppliers. You may view and use this content for personal, non-commercial purposes only, and may not copy, distribute, reproduce, or otherwise use it without our prior written permission.

6. Reporting Copyright or IP Infringement

If you believe content on the Site infringes a copyright or other proprietary right belonging to you, please contact us using the details at the end of this document, and we will address your request promptly.

7. Third-Party Content and Links

The Site may include links to external websites. We are not responsible for the content, privacy practices, or policies of these sites, and use of them is at the user’s own risk.

8. Products, Brands, and Pricing

Wallace is a multi-brand store, and some products offered on the Site are manufactured and/or imported by third-party brands and manufacturers. If a manufacturing defect is found in a product, your rights as a consumer against us remain unaffected under the Consumer Protection Law, and we may in turn seek recourse from the relevant manufacturer or importer.

Prices shown on the Site are in New Israeli Shekels (₪) and include VAT as required by law, unless stated otherwise. We reserve the right to update prices and product availability at any time, provided this does not affect orders already confirmed. Colors as displayed on screen may differ slightly from the actual product.

Some items on the Site may contain materials that can cause sensitivity in certain people (such as latex). We recommend reading the product label before use, and discontinuing use and consulting a doctor in case of an unwanted allergic reaction.

9. Placing an Order

Completion of an order is subject to stock availability and payment approval. If an item is out of stock after an order is placed, we will notify the customer and offer a full refund or a replacement item, at the customer’s choice.

10. Payment

Payment is made using the payment methods offered on the Site at checkout. Credit card details are processed directly by a secure payment provider and are not stored by us.

11. Shipping and Delivery Policy

Delivery methods and costs will be shown at checkout. A “business day” means Sunday through Thursday, excluding national holidays, holiday eves, and days on which banks in Israel are closed.

Delivery times stated on the Site are estimates and do not constitute an absolute commitment. We are not responsible for delivery delays caused by force majeure, events beyond our control, or circumstances related to our courier or Israel Post.

If a customer requests that an order be left at the door or with a neighbor, responsibility for the product from that point transfers to the customer. If the courier cannot find the customer at a pre-arranged delivery time, the order will be redelivered subject to payment of an additional delivery fee.

13. Marketing Communications

Details on how we obtain consent for marketing communications, and how to unsubscribe, are set out in our Privacy Policy.

14. Limitation of Liability and Indemnification

Use of the Site is at the user’s own risk. We are not liable for indirect damages arising from use of the Site, except to the extent that liability cannot be limited under the Consumer Protection Law.

A user who breaches these terms agrees to indemnify us for any damage, loss, or expense (including legal fees) we incur as a result of that breach.

15. Governing Law and Jurisdiction

These Terms of Sale are governed exclusively by the laws of the State of Israel, without regard to its conflict-of-laws rules. The competent courts of the Tel Aviv district shall have exclusive jurisdiction.

16. Changes to These Terms

We may update these Terms of Sale from time to time. The updated version will apply to orders placed after its publication date.

3. מי רשאי להשתמש באתר

הגלישה באתר מותרת בכל גיל. רכישה באתר מיועדת למשתמשים בעלי כשירות משפטית מגיל 18 ומעלה; רכישה על ידי קטין מתחת לגיל 18 טעונה אישור הורה או אפוטרופוס.

4. שימוש מותר באתר

השימוש באתר מותר למטרות פרטיות ואישיות בלבד, ולא למטרות מסחריות, אלא אם אושר הדבר מראש ובכתב על ידינו. בין היתר, אין: לאסוף תוכן מהאתר לצורך בניית מאגר מידע או מוצר מתחרה; לעשות שימוש בבוטים, סקריפטים או כלים אוטומטיים אחרים לגישה לאתר; לנסות לעקוף, להשבית או לפרוץ אמצעי אבטחה של האתר; להתחזות לאדם אחר; או לבצע כל פעולה המנוגדת לחוק. אנו רשאים, לפי שיקול דעתנו הבלעדי, להגביל או לחסום גישה לאתר למשתמש שמפר תנאים אלו, ללא צורך בהודעה מוקדמת.

5. קניין רוחני

כל התכנים באתר – לרבות עיצוב, תמונות, טקסטים, קוד וסימני מסחר – הם רכושה הבלעדי של Wallace ו/או ספקיה. ניתן לצפות ולהשתמש בתכנים אלו לצורך אישי ולא-מסחרי בלבד, ואין להעתיקם, להפיצם, לשכפלם או להשתמש בהם למטרה אחרת ללא אישור מראש ובכתב.

6. הפרת זכויות יוצרים וקניין רוחני

אם לדעתכם תוכן באתר מפר זכות יוצרים או זכות קניינית אחרת השייכת לכם, נשמח שתפנו אלינו בפרטי הקשר שבסוף מסמך זה, ונטפל בפנייתכם בהקדם.

7. תוכן וקישורים של צדדים שלישיים

האתר עשוי לכלול קישורים לאתרים חיצוניים. איננו אחראים לתוכן, למדיניות הפרטיות או לפרקטיקות של אתרים אלה, והשימוש בהם הוא באחריות המשתמש בלבד.

8. המוצרים, המותגים והמחירים

Wallace הינה חנות מולטי-בראנד, וחלק מהמוצרים המוצעים באתר מיוצרים ו/או מיובאים על ידי מותגים ויצרנים שלישיים. ככל שיתגלה פגם ייצור במוצר, זכויותיכם כצרכנים כלפינו עומדות בעינן בהתאם לחוק הגנת הצרכן, ואנו עשויים לפנות בתורנו ליצרן או ליבואן הרלוונטי.

המחירים המוצגים באתר הם בשקלים חדשים (₪) וכוללים מע“מ כדין, אלא אם צוין אחרת. אנו שומרים לעצמנו את הזכות לעדכן מחירים וזמינות מוצרים בכל עת, ככל שאין בכך פגיעה בהזמנות שכבר אושרו. ייתכנו הבדלים קלים בין הצבעים כפי שהם מוצגים על גבי המסך למוצר בפועל.

חלק מהפריטים באתר עשויים לכלול חומרים העלולים לגרום לרגישות אצל חלק מהאנשים (כגון לטקס). מומלץ לקרוא את תווית המוצר לפני השימוש, ובמקרה של תגובה אלרגית בלתי רצויה יש להפסיק את השימוש ולפנות לרופא.

9. ביצוע הזמנה

השלמת הזמנה כפופה לאישור זמינות המלאי ואישור עסקת התשלום. במקרה שמוצר אזל מהמלאי לאחר ביצוע ההזמנה, נודיע ללקוח ונציע החזר כספי מלא או מוצר חלופי, לפי בחירתו.

10. תשלום

התשלום מתבצע באמצעי התשלום המוצעים באתר בעת ביצוע ההזמנה. פרטי כרטיס האשראי מעובדים ישירות על ידי ספק סליקה מאובטח ואינם נשמרים על ידינו.

11. מדיניות משלוח ואספקה

אופני ועלויות המשלוח יוצגו בעת ביצוע ההזמנה. “יום עסקים” – ימי ראשון עד חמישי, לא כולל ימי שבתון של המשק, ערבי חג וימים בהם הבנקים בישראל אינם פעילים.

זמני האספקה המצוינים באתר הם משוערים ואינם מהווים התחייבות מוחלטת. איננו אחראים לעיכוב באספקה שנגרם כתוצאה מכוח עליון, מאירועים שאינם בשליטתנו, או מנסיבות הקשורות לחברת השילוח או לדואר ישראל.

אם הלקוח ביקש להשאיר את ההזמנה ליד הדלת או אצל שכן, האחריות למוצר ממועד ההשארה עוברת ללקוח. אם השליח לא מצא את הלקוח בזמן שתואם מראש, ההזמנה תישלח שוב בכפוף לתשלום דמי משלוח נוספים.

12. ביטול עסקה והחזרות

לתנאי ביטול עסקה והחזרת מוצרים, ראו את “מדיניות הביטולים וההחזרות” שלנו, המהווה חלק בלתי נפרד מתקנון זה.

13. דיוור ותקשורת שיווקית

פרטים על אופן איסוף ההסכמה לדיוור שיווקי, ועל אפשרויות ההסרה ממנו, מפורטים במדיניות הפרטיות שלנו.

14. הגבלת אחריות ושיפוי

השימוש באתר הוא באחריות המשתמש. איננו אחראים לנזק עקיף שייגרם כתוצאה משימוש באתר, למעט ככל שמוטלת עלינו אחריות שאינה ניתנת להגבלה על פי חוק הגנת הצרכן.

משתמש שיפר תנאים אלה מתחייב לשפות אותנו בגין כל נזק, הפסד או הוצאה (לרבות שכר טרחת עורך דין) שייגרמו לנו כתוצאה מהפרתו.

15. דין וסמכות שיפוט

על תקנון זה יחולו דיני מדינת ישראל בלבד, ללא תחולה לכללי ברירת הדין הבינלאומי הקבועים בהם. סמכות השיפוט הבלעדית נתונה לבתי המשפט המוסמכים במחוז תל אביב.

16. שינויים בתקנון

אנו רשאים לעדכן תקנון זה מעת לעת. הנוסח המעודכן יחול על הזמנות שבוצעו לאחר מועד פרסומו.
